Esta Web está dedicada a la protección de la diversidad biológica marina en zonas más allá de la jurisdicción nacional desde una perspectiva legal.
En ella se puede encontrar toda la información relevante sobre el nuevo acuerdo que se está negociando sobre esta materia conocido como ‘the BBNJ Agreement’ por sus siglas en inglés (Biodiversity Beyond National Jurisdiction).
Asimismo, hay un apartado que recopila todas las publicaciones del grupo de investigación detrás de esta web en esta materia, así como los Trabajos de Fin de Grado y Máster dirigidos por este grupo.

¿Qué es la diversidad biológica marina?
La biodiversidad marina o diversidad biológica marina es el término que define la amplia variedad de seres vivos dentro de este medio, especies microscópicas y macroscópicas, y los genes que habitan entre ellos.
¿Más allá de la jurisdicción nacional?
Las áreas más allá de la jurisdicción nacional engloban la Alta mar y la Zona.
La alta mar la define la Convención de Naciones Unidas de Derecho del Mar de forma negativa, como aquellas no comprendidas en la zona económica exclusiva, en el mar territorial, ni en las aguas interiores archipelágicas de ningún Estado. La alta mar no puede ser sometida a la soberanía de ningún Estado y se rige por el principio de libertad.
La Zona o los fondos marinos son los fondos oceánicos más allá de los límites exteriores de las zonas económicas o de las plataformas continentales, y se rigen por el principio de patrimonio común de la humanidad.
BBNJ - Biodiversity Beyond National Jurisdiction
Desde la adopción de la Convención de las Naciones Unidas sobre el Derecho del Mar ha habido un notable interés, pero no tan extensa regulación en la Comunidad Internacional respecto a la conservación y protección de la diversidad biológica marina. Este compromiso continúa reforzado por la Agenda 2030 que incluye la conservación y sostenibilidad de los océanos como su Objetivo 14 en los Objetivos de Desarrollo Sostenible de Naciones Unidas.
En las últimas décadas, y liderado por la Asamblea General de las Naciones Unidas, se ha realizado un esfuerzo hacia la adopción de un instrumento internacional jurídicamente vinculante sobre la conservación y el uso sostenible de la diversidad biológica marina de las zonas más allá de la jurisdicción nacional (también conocido como el Acuerdo BBNJ).
Debido a la pandemia del COVID-19 las negociaciones se pospusieron en 2020, y el Acuerdo no verá la luz antes de la quinta (y previsiblemente última) sesión de negociaciones, que tendrá lugar en agosto de 2022. Sin embargo, existen algunas discrepancias entre los Estados Parte en ciertos elementos clave del Acuerdo que aún deben ser debatidos.
El Acuerdo se basa en el «paquete de medidas» (Package Deal): (i) los mecanismos de gestión basados en la zona, incluidas las áreas marinas protegidas; (ii) las evaluaciones de impacto ambiental; (iii) los recursos genéticos marinos y el reparto de beneficios y; (iv) la creación de capacidades y la transferencia de tecnología marina.
